1. Conditions of registration.
The purpose of the present Terms and Conditions is to define the terms and conditions according to which ECONEVES sells its products to customers from its Waterflush website. ECONEVES points out that its sales are exclusively reserved to individuals who have reached the age of majority and agree to fill in the mandatory fields provided at the time of registration. Its sales are also reserved to individuals with a physical address of residence and a frequently checked e-mail inbox.
The Waterflush website is the property of ECONEVES in its entirety, as well as all the rights relating to it. Any reproduction, complete or partial, is systematically subjected to the authorization of the owners. However, hypertext links to the site are authorized without specific requests.
Acceptance of the conditions.
When customers finalize their order by clicking on validation, they acknowledge having read, at the time of placing the order, the Terms and Conditions (T&C) stated on this screen and expressly declare that they agree to them without reservation.
If you do not agree to these T&Cs, you cannot order our products on Waterflush. If you have any questions regarding these terms and conditions, please send us an email to email@example.com.
We reserve the right to change these T&Cs at any time by posting the new version online. This new version of the Terms and Conditions will come into force as soon as you register as a new customer and 30 days after it has been posted online if you are already a Waterflush customer. A message informing you of the modification of the Terms and Conditions will be displayed on the home page and sent to registered customers. If you do not accept the new version of the Terms and Conditions, you will not be able to purchase from Waterflush after this 30-day period.
These General Terms and Conditions govern the contractual relationship between Waterflush and its customer and are accepted by both parties without reservation. These general terms and conditions of sale shall prevail over any other terms and conditions contained in any other document unless otherwise agreed in advance, expressly and in writing.
Waterflush reserves the right to modify these general terms and conditions but in return agrees to indicate this on the website by means of a "New Terms and Conditions" banner.
2. Terms and conditions of sale
Photos illustrating the products are not contractual. Waterflush cannot be held responsible for any errors that may have been introduced. Waterflush agrees to take the necessary steps as quickly as possible to correct any error or omission that any Internet user may indicate. The majority of the products offered to its customers are available in stock in our factory or at our collection point 85 rue Daguerre 75014 Paris.
Automatic registration systems are considered as proof for the content of the order and date of the order. Waterflush confirms the acceptance of the order to the customer at the e-mail address provided by the customer. The sale will only be concluded once the order has been confirmed. Waterflush reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order. The information provided by the purchaser when placing an order is binding on the purchaser: in the event of an error in the wording of the recipient's contact details, the vendor cannot be held responsible for the impossibility of delivering the product. For reasons of availability, an order can be delivered in several times to the customer. The customer then pays for only one delivery. If the customer wishes 2 delivery locations, he/she makes 2 orders with the related delivery costs.
The products are available for sale as long as they are visible on the Waterflush website. In the event of a temporary out-of-stock condition of a product at the time of the order, we will inform you by e-mail as soon as possible and indicate the availability period. In the event of a product being out of stock for more than thirty (30) days, your order cannot be confirmed and you may cancel it. The sums you have already paid to Waterflush will be considered as a deposit. Waterflush will reimburse you either directly through the CB Crédit Agricole server or by bank transfer or check as soon as possible.
2.2 Prices and payment
The prices of the products appear on the product pages available online, at the date of the order. The prices are shown in euros all taxes included (VAT at the current rate) for individuals. For export outside Europe, duties or customs charges are not included and must be paid by the customer residing outside Europe.
The price indicated in the order confirmation is the final price. This price includes the price of the products, handling, packaging and storage costs, and in some cases transport costs.
The price of the products is payable in full on the day of the order.
The price invoiced to the Customer is the price indicated on the order confirmation sent by Waterflush.
The transport costs are specified on the shopping cart page when you have validated your order. They include delivery to your home. In the case of export (outside Europe) charges or customs duties may be claimed by the customs authorities of the country concerned.
The payment of the products and related costs is made online by credit card or other payments indicated, at the time of placing the order on the Waterflush website, for the full amount. Waterflush does not accept partial or deferred payments.
Online payment is made by credit card via a bank server in a secure environment. This one carries the CB logo online: Crédit Agricole or PayPal.
The credit card number is therefore directed to the bank's servers, the payment being made directly to a bank in a secure environment without going through the store's server, a guarantee that is all the more important as the numbers are known only to our banking partners Crédit Agricole or PayPal.
The order validated by the customer will be considered effective only when the concerned banking facilities have given their agreement. In case of refusal of the said facilities, the order will be automatically cancelled and the customer notified by e-mail. In addition, Waterflush reserves the right to refuse any order from a customer with whom there is a dispute.

Payment by check
The check is to be made out to ECONEVES and sent to the following address:

For your information, payment by check is limited to 10 days from the date of your order. After this period we consider that you have cancelled your order and it will therefore be cancelled by our sales department.
Payment by bank transfer
This type of payment is also accepted. We will provide you with our bank details as soon as you confirm your order. For your information, payment by bank transfer is limited to 6 days from the date of your order. After this period we consider that you are cancelling your order and it will therefore be cancelled by our sales department.
Delivery is the transfer to the consumer of the physical possession or control of the good (article L. 216-1 paragraph 3 of the French Consumer Code).
Delivery times in Metropolitan France are a minimum of 2 working days, on products in stock and not on pallets, e.g. basins.
However, should the delivery time be longer, Waterflush will inform the customers.
For reasons of availability, an order may be delivered in several times to the customer.
The products are delivered to the delivery address indicated by the customer when the order is placed.
Consequences of failure to meet the deadline.
If the deadline announced is exceeded by 30 days consumers can cancel their order by email to firstname.lastname@example.org or by registered letter with acknowledgement of receipt.
The delivery of the products is carried out either by a service provider, such as Colissimo or DHL for customers outside of France.
In case of absence during the delivery (by Colissimo) to the address indicated by the customer, a delivery notice will be left in the mailbox.
The customer will have to withdraw the parcel at the location indicated and within the time specified on the notice.
Any false or erroneous information may be subject to additional charges.
Possible delays do not give the customer the right to claim any compensation, delivery times may vary according to cases of force majeure discharging the seller from its obligation to deliver, such as fire, strikes, accidents, war, riots or the inability to be supplied due to climatic or transport problems.
The goods are shipped at the recipient's risk. Customers should always check their package upon arrival. Upon delivery and before signing the delivery note, the customer is required to check and unpack the package. If the package is damaged, the customer must indicate this on the carrier's delivery note and, in the event of significant damage or missing items, refuse delivery. Do not forget to inform Waterflush by e-mail (maximum delay 48 hours).
Refusal of the package
If you refuse a package, contact ECONEVES customer service within 48 hours. Please follow this procedure. By following it, Waterflush commits to:
1. to reship your item according to its availability,
2. or to reimburse you the totality of your order (shipping costs included).
For any return, we will ask you to send us back the products in their original packaging. Make sure you keep them in good condition!
Shipping must be confirmed with the carrier within 48 hours by registered letter with acknowledgement of receipt with the reference of the delivery slip and send a copy to ECONEVES at the address: 85 rue Daguerre, 75014 Paris France.
In case of apparent defects, the buyer has the right to return the goods under the conditions provided for in this document.
In the event of loss or destruction of the package, the amount of the sale, plus delivery costs, will be refunded to you within thirty (30) days at the latest following the date on which the copy of the registered letter of the declaration of loss or destruction of the package is received by ECONEVES. Reimbursement will be made by bank transfer or check.
3.0 Personal data
For the purposes of data processing inherent to Waterflush's commercial activity, it is specified to the Buyer that Waterflush may collect, process and transfer personal data of its customers, who have the right to access, modify, rectify and delete data concerning them, in accordance with the French law n°78-17 of January 6, 1978 on Data Processing, Data Files and Individual Liberties.
Waterflush agrees to comply with the European Regulation for the Protection of Personal Data (RGPD) n° 2016/079 which came into effect on May 25, 2018. As such, in the event that Waterflush collects personal data for a particular processing, it will inform the person concerned at the time of collection while respecting the principle of transparency and guaranteeing a right of access to its data (email@example.com).
3.1 Professional Registration: Go to www.econeves.com.
You must create your account, fill in the form on ECONEVES.com. Validate your registration then wait for the validation of the Account by ECONEVES under 48 hours.
After this validation, you will be able to access your professional page to benefit from additional technical information, download documents, leave messages etc...

3.3 Account Security
The login data (log-in and/or password) allowing you to connect to your Waterflush account are personal and confidential. For security reasons, you will not disclose your log-in and password to anyone. You will be solely responsible for all consequences of a contractual, financial or other nature that may result from any unauthorised use of your login data by third parties. Waterflush reserves the right to suspend your account if we have reason to believe that your login details have been stolen or used without your consent.
Your personal data is stored on servers located in France. Waterflush and its hosting provider have taken appropriate measures to ensure the security of your personal data. However, we cannot guarantee that your communications and other personal data will not be intercepted or disclosed by a third party.
3.4 Right to access or close your WaterFlush account
You have the right to access your Waterflush account online to change your personal data or to close your Waterflush account. If you choose to close your Waterflush account, your data will be deleted. We may, however, retain personal data as permitted by law and as necessary in connection with any disputes between you and Waterflush. Your personal data will, however, be deactivated and will no longer be accessible online.

4. Industrial Property
The WATERflush tank is protected by patents in France, Europe and other countries. Models and drawings are duly registered at the INPI. The WATERflush brand and logo are registered at the INPI. All the tanks are manufactured in France.
5. Liability limits
5.1 Regarding products for sale
The products offered for sale comply with current French legislation. The descriptions of the products offered on the Waterflush website correspond to the information provided by the supplier. The photographs and texts reproduced and illustrating the products presented are not contractual and are provided for information purposes only.
Any error found will be corrected as soon as possible, from the date of its notification to Waterflush. Waterflush shall not be held liable for any damage of any kind, whether material or immaterial, which may result from a malfunction or improper use of the products marketed. The same applies to any modifications to the products resulting from suppliers. In general, Waterflush, one of our partners or our agents may not be held liable for the use that you make of the products or information and services offered on the Waterflush website. In any event, Waterflush's liability shall be limited to the amount of the order and shall not be held liable for any simple errors or omissions despite the precautions taken in the presentation of the Products.
5.2 Regarding hypertext links
This site may include hypertext links to third party websites. We can in no way be held responsible for any damage, direct and/or indirect, which could result from the use of content, data or information of any kind, accessible from hypertext links published on the site. Nor can we be held liable for any damage, direct and/or indirect, which may result from the use of information appearing on third party websites accessible from the Waterflush service or in downloadable files accessible on these third party websites from hypertext links published on the Waterflush website. It is your responsibility to check that the information appearing on the third party sites is accurate, consistent, complete and complies with regulations.
Object of the warranty
Our Waterflush toilet tanks are guaranteed for 10 years against manufacturing defects when installed and used under normal conditions. The burden of proof of such use lies with the person claiming the manufacturing defect. If a latent defect is discovered, you must notify your request within the time limits and according to the terms and conditions set out in articles 1641 and following of the Civil Code.
The 10-year warranty by ECONEVES, in the event that it is accepted by our services, is limited to the repair (or the replacement of an identical item, upon ECONEVES' decision), or the equivalent of materials or parts that we have recognized as defective, to the express exclusion of all accessory costs (particularly disassembly and reassembly) and direct and indirect damages (particularly those resulting from deprivation of use of the installations).
The warranty does not cover maintenance by the user of our products (cleaning of filters, lubrication, change of seal, wear of parts such as the float, etc.).
Tanks manufactured and sold by ECONEVES are guaranteed against any manufacturing defect for a period of 10 years from the date of invoice and its presentation. During this warranty period, products recognized as defective by ECONEVES will be exchanged.
The products recognized as faulty at the time of their first use will be replaced free of charge and as soon as possible by ECONEVES on condition that they have been returned after our agreement and to the address indicated at the time of our exchanges within 15 days after their date of purchase.
The return of an item is to be made imperatively in its original state and complete (packaging, accessories, instructions...) allowing its re-marketing in new condition, and accompanied by a copy of the purchase invoice.
-Validity of the guarantee.
The 10-year warranty only covers manufacturing defects caused by an internal problem with the product.
-The warranty is valid for normal use of the products and does not cover: damage whose cause is external to the product: misuse, shock or fall, poor connection to the water system, poor attachment to the toilet bowl, insufficient protection against frost, oxidation, scaling, modification or repair (or an attempt to do so) not carried out by a plumber and generally damage of any kind whose origin is subsequent to the sale.
-damage suffered by the user as a result of a malfunction of the product.
7. Force majeure
We cannot be held responsible for any failure to meet our obligations under these T&Cs due to events beyond our control, events from a third party and/or resulting from a case of force majeure. Cases of force majeure shall include, in particular, in addition to the cases recognized by jurisprudence, all natural disasters, all acts of war, breaches of public order, epidemics, fires, floods and other disasters, all governmental acts, all strikes, lockouts, as well as all electrical and technical problems external to the parties and preventing communications.
8. Fraudulent behaviour and attacks on the integrity of the website
You agree not to use software or manual processes to copy our web pages or to save or collect information on these pages without the express prior written consent of ECONEVES. You agree not to use any device or software to disrupt or attempt to disrupt the proper operation of our service. You agree not to implement any action that would impose a disproportionate burden on our infrastructure. You agree not to reproduce, alter, modify, or create derivative works from all or part of the content of our website.
9. Duration and termination
This contract comes into force when you have completed the registration procedure on the Waterflush website, for an indefinite period.
We may, and you may terminate it at any time, subject to the following conditions:
- in the event of a request from you to close your customer account, in accordance with the terms and conditions described in article 3.4 and subject to the complete execution of the last order in progress,
- in the event of use of your account contrary to these Terms and Conditions, and in the event of payment fraud, attempted fraud or any other offence. In this case, we will send you a notification email asking you to correct the violations of the T&Cs within 48 hours. In case of failure to correct within this period, we then reserve the right to close your user account without further notice. Any account closure initiated by ECONEVES will be carried out without prejudice to the compensation of the whole damage possibly suffered by ECONEVES as a result of your actions on the Waterflush website.
You have 14 days to retract without having to justify your reasons or pay any penalties, with the exception of return shipping costs. This period starts from receipt of the package. Article L121-21 modified by French law LOI n° 2014-344 of March 17, 2014 - art. 9 (V)
Consequences of the exercise of the right: Obligation to return the product without delay and within 14 days.
You can notify us of your choice of withdrawal by sending us your request by e-mail (see Article 10) to email@example.com . Please note that in the event of a dispute, it is up to the customer to provide proof of his or her withdrawal. It is thus advisable to use a mode of sending allowing this proof (e.g. registered mail with acknowledgement of receipt or e-mail).
Unless expressly stipulated otherwise, any notification sent to ECONEVES must be sent by post to ECONEVES at the following address: 85, rue Daguerre 75014 Paris France.
Any notification intended for you will be sent by e-mail to the address provided in your customer account. Notifications are deemed to have reached you 24 hours after an e-mail is sent, unless the sender is notified of the invalidity of the e-mail address.
Notices may also be sent to you by registered letter with acknowledgement of receipt to the address provided in your customer account. In this case, the notifications are deemed to have reached you within 48 hours after the mail was sent.
This contract is subject to French law. ECONEVES cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which could result from a malfunction or misuse of the products marketed. The same applies to possible modifications of the products resulting from trading with other manufacturers. ECONEVES's liability shall in any event be limited to the amount of the order and shall not be held liable for simple errors or omissions despite all precautions taken in the presentation of the Products. In case of difficulties in the application of the present contract, the purchaser has the possibility, before any legal action, to seek an amicable solution in particular with the help of a professional association of the branch, a consumer association or any other council of choice.
It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the discretion of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that buyers fulfill their financial commitments to the seller.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the one who takes the trouble to expose their situation. In the event of a dispute, the customer will address by priority to the company to obtain an amicable solution. Failing this, the Commercial Court of Paris has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.
Les réclamations ou contestations seront toujours reçues avec bienveillance attentive, la bonne foi étant toujours présumée chez celui qui prend la peine d'exposer ses situations. En cas de litige, le client s'adressera par priorité à l'entreprise pour obtenir une solution amiable. A défaut, le Tribunal de Commerce de Paris est seul compétent, quels que soient le lieu de livraison et le mode de paiement accepté.
